1. General Provisions

1.1. These Terms and Conditions (hereinafter – “Terms”), once the Buyer agrees with them (by reviewing the Terms and checking the box “I have read and agree to the terms and conditions of www.sparkflair.lt”), constitute a binding legal document for both parties. They define the Buyer’s and Seller’s rights and obligations, terms of product purchase and payment, delivery and return procedures, liability of the parties, and other provisions related to purchasing at www.sparkflair.lt online store.
1.2. The Seller reserves the right to amend or supplement the Terms at any time, in accordance with applicable legal requirements. Registered Buyers will be notified of such changes via the email address provided, and in order to continue purchasing in the store, they must agree to the updated Terms.
1.3. The right to purchase from our online store belongs to:
1.3.1. Natural persons over 18 years of age whose legal capacity is not restricted by court.
1.3.2. Minors aged 14–18 with parental or guardian consent, unless they independently dispose of their own income.
1.3.3. Legal entities.
1.3.4. Authorized representatives of all the above.

2. Personal Data Protection

2.1. www.sparkflair.lt has the right to collect and process the personal data provided by the Buyer, when necessary for order fulfilment. Personal data may be used for marketing purposes (sending promotions, newsletters) only with the Buyer’s consent.
2.2. The Buyer may prohibit the collection and processing of their data for marketing purposes by notifying info@sparkflair.lt, except when such processing is necessary for fulfilling purchase obligations.
2.3. Buyer and visitor data is protected from loss, unauthorized use, or alteration. The online store uses an SSL certificate to ensure secure data transmission.

3. Conclusion of Purchase–Sale Agreement

3.1. The contract between Buyer and Seller is considered concluded when the Buyer selects a product, places it in the shopping cart, and clicks the “Pay” button.

4. Buyer’s Rights

4.1. The Buyer has the right to purchase products from www.sparkflair.lt in accordance with these Terms and the store’s established procedures.
4.2. The Buyer has the right to withdraw from the purchase within 14 business days of delivery by notifying the Seller in writing (email) with the order number and product details.
4.3. This right applies only if the product has not been damaged, used, or significantly altered in appearance, and complies with Lithuanian retail trade regulations.

5. Buyer’s Obligations

5.1. Accept ordered products and pay the price (including delivery fees, if applicable).
5.2. Update personal data if it changes.
5.3. Not disclose login details to third parties; if lost, notify the Seller immediately.
5.4. Use the store in accordance with these Terms and Lithuanian law.

6. Seller’s Rights

6.1. Restrict or terminate access if the Buyer attempts to harm store operations.
6.2. Temporarily suspend or terminate store operations under exceptional circumstances.
6.3. Cancel orders if payment is not made within 3 business days.
6.4. Refuse further sales to Buyers who repeatedly return items (2+ times within 12 months).
6.5. Cancel agreements if stock is unavailable or the order was made by ineligible persons.

7. Seller’s Obligations

7.1. Deliver products to the Buyer at the specified address within agreed terms.
7.2. If unable to supply, offer an alternative product or refund the Buyer within 14 business days.

8. Prices and Payment

8.1. Prices are shown in euros. The Seller reserves the right to change prices due to tax changes.
8.2. Prices in the online store may differ from prices elsewhere.
8.3. Payment is made by bank transfer to Spark Flair’s account provided during checkout.

9. Delivery

9.1. Products are delivered by the Seller or an authorized representative.
9.2. Delivery terms are outlined in the “Delivery” section. In special cases, delays may occur due to force majeure.
9.3. Buyer must personally accept goods or ensure acceptance at the indicated address.
9.4. Upon delivery, Buyer must inspect the shipment and sign the receipt; otherwise, claims cannot be made later.
9.5. If the Buyer withdraws from the contract, they cover return shipping costs.

10. Returns and Exchanges

10.1. Returns and exchanges follow Lithuanian retail trade regulations.
10.2. Products can be returned within 14 business days of delivery, if unused, undamaged, and in original packaging with purchase documents.
10.3. If incorrect or faulty items are received, the Seller covers return costs and replaces or refunds them.
10.4. The Seller may refuse returns if conditions are not met.

11. Liability

11.1. The Buyer is responsible for the accuracy of registration data.
11.2. The Buyer must keep login details secure.
11.3. All actions performed with Buyer credentials are considered Buyer’s responsibility.
11.4. The Seller is not responsible for third-party websites accessed through links on the online store.

12. Communication

12.1. The Seller communicates with the Buyer via the email provided in the registration form.
12.2. The Buyer communicates with the Seller using the contact details listed in the “Contacts” section.

13. Final Provisions

13.1. Lithuanian law applies to these Terms.
13.2. Disputes are resolved through negotiations. If unsuccessful, disputes are settled according to Lithuanian legislation.
